Article 1 (Purpose)
These Terms of Service (hereinafter "Terms") are intended to define the rights, obligations, and responsibilities between Arclair Inc. (hereinafter "Company") and users regarding the use of all services provided by the Company (including web, mobile apps, and platforms, hereinafter "Services").
Article 2 (Scope of Application)
- These Terms apply commonly to all Services provided by the Company.
- If there are separate terms or operating policies for specific Services, those terms or policies shall take precedence.
- The Company clearly displays business information (trade name, representative name, business registration number, e-commerce registration number, location, contact information, etc.) within the Service.
Article 3 (User Eligibility)
- Users in the Republic of Korea must be 14 years of age or older to use the Service.
- Global users must be 13 years of age or older, and additional restrictions may apply according to relevant laws in each country.
- Minors under 18 years of age require consent from a legal guardian to use paid Services.
Article 4 (Membership Registration and Account Management)
- Membership registration is done through email or social login via Google/Apple accounts.
- Some Services may require identity verification procedures.
- Users are responsible for managing their accounts and passwords and cannot transfer or lend them to third parties.
- The Company may restrict or terminate account usage if users violate these Terms or laws, or significantly interfere with service operations.
Article 5 (Paid Services and Payment)
- Payment for paid Services is made through Google Play, App Store in-app purchases, or credit card payments.
- The Company may use third-party payment agency services such as RevenueCat and Paddle.
- Refunds and payment cancellations are governed by Article 6 (Withdrawal of Subscription and Refunds).
Article 6 (Withdrawal of Subscription and Refunds)
- Users may withdraw their subscription within 7 days from the contract date or service availability date in accordance with the "Act on Consumer Protection in Electronic Commerce, etc."
- However, withdrawal may be restricted in the following cases:
- When goods or content are damaged due to reasons attributable to the user
- When the user has already partially used or consumed the Service
- When packaging of reproducible digital content is damaged
- When content provision has immediately commenced or when download/streaming has started with user consent
- The Company will refund the payment within 3 business days from receiving a legitimate withdrawal request. If the refund process is inevitably delayed, it will be processed within the scope defined by relevant laws.
- When calculating the refund amount, the amount corresponding to the period already used or the portion of the Service used may be deducted proportionally.
- For withdrawal due to simple change of mind, the user shall bear the costs necessary for return. However, if it is due to the Company's fault, the Company shall bear the costs.
- If service provision is delayed or impossible, the Company will promptly notify users and proceed with refund procedures for prepaid amounts in accordance with relevant laws.
Article 7 (Rights to User Content)
- The copyright of content posted or uploaded by users to the Service (hereinafter "User Content") principally belongs to the user.
- However, users grant the Company a worldwide, non-exclusive, royalty-free, transferable right to use such content, including the right to create derivative works and sublicense.
- This includes not only purposes of providing, operating, and improving the Service, but also purposes of advertising, promotion, and marketing related to the Company and its Services.
- Users warrant that their User Content does not infringe third-party rights, and the Company is not liable for disputes arising from infringement of third-party rights.
Article 8 (Prohibited Conduct)
Users shall not engage in the following conduct:
- Illegal activities, copyright infringement, posting obscene/harmful information
- Activities that interfere with service operations
- Illegal use such as spam, reverse engineering, etc.
- Other activities that are contrary to social order or significantly impair the Company's reasonable operations
Article 9 (Service Changes and Suspension)
- The Company may change or suspend all or part of the Service, and in principle will provide notice of such changes within a reasonable period (30 days in advance).
- However, in cases of urgent security threats, legal changes, technical necessity, or other unavoidable circumstances, notice may be provided after the fact.
Article 10 (Changes to Terms)
- The Company may revise the Terms, and when doing so, will announce the effective date and reason starting 7 days before the effective date of the revised Terms.
- For changes that are disadvantageous or significant to users, notice will be provided at least 30 days in advance.
- In cases where immediate application is unavoidable due to legal revisions or urgent reasons, the Company may immediately apply the revisions and promptly notify users after the fact.
Article 11 (Dispute Resolution and Governing Law)
- These Terms shall be governed by the laws of the Republic of Korea.
- Disputes between the Company and users shall be resolved amicably through consultation whenever possible.
- If agreement cannot be reached, jurisdiction shall be with the Seoul Central District Court.
- Users may apply for dispute mediation through relevant organizations such as the Korea Consumer Agency or the Fair Trade Commission if necessary.
Article 12 (Language)
These Terms are provided in Korean and English. In case of any discrepancy between the two languages, the Korean version shall prevail for users in the Republic of Korea, and the English version shall prevail for users in other regions.
